Terms and Conditions of Agreement
These Terms and Conditions govern the customer’s relationship with Mediphi Medical Travel Limited Company, located at “www.mediphi.co”. They apply the use of Mediphi services and websites and any health data uploaded, downloaded or appearing on the Services. By accepting them, patients are legally bound by them.
Acceptance of Terms
By using the website www.mediphi.co and our services, patients confirm that they accept these Terms and Conditions and agree to comply with them. These Terms and Conditions are a contract between patients and Mediphi that commences upon their acceptance of them. If patients do not agree to these Terms and Conditions, they must not use the Mediphi website or services. Patients are strongly recommended to print a copy of these Terms and Conditions for future reference.
Definitions
“Agreement” – This Agreement.
“Terms and Conditions” – These Terms and Conditions.
“Providers” – The hospital, private clinic, surgeon or any other medical professional providing your consultation, examination, medical procedure and care and aftercare.
“Destination” – The place (the country and/or city) to which you will be travelling for your medical treatment.
“Package” – The combination of surgery, accommodation, private transfers, host and pre-operative tests (if required) you have chosen to purchase from Mediphi.
“Procedure” – The medical treatment or surgery you have chosen to undertake.
“Patient” - The people who get the services provided by Mediphi and the Providers.
“Website” - www.mediphi.co
Mediphi Service and Responsibilities
- Mediphi is a service platform whose purpose is the provision of a marketplace for medical service providers, including but not limited to hospitals and clinics. Mediphi does not provide medical services itself; it only provides representative information of the providers’ services. The information provided on the Website, including the information provided by the Providers and other third parties, does not constitute medical consultation, medical treatment or a medical examination and shall not be used to decide whether to commence or terminate a medical treatment independently.
- Mediphi does not hold medical qualifications and shall not be held responsible or liable for any medical procedures provided through the Patient’s chosen Service Provider. Nor shall be held responsible or liable for any care, treatment or other services the Patient is provided with by the same, or for any malpractice, negligence or any other claims that may arise directly or indirectly from their advice. Similarly, Mediphi shall not take any responsibility or liability for the complications and dissatisfactions arising from Service Provider’s treatments. Mediphi’s role is solely to facilitate consultation and/or dialogue between the Patient and Provider. Patients are strongly recommended that they read Service Provider’s terms and conditions and consent forms carefully prior to proceeding with their treatments.
- By accepting these Terms and Conditions, patients agree not to hold Mediphi responsible for medical negligence or malpractice by their chosen Provider.
- Mediphi provides a catalogue of Providers ranked automatically with the most objective information and without the interference of Providers. Patients are entitled to choose the Provider suitable for their treatment by using the filters available and the Website itself to make an appointment with.
- Mediphi does not assign the Patient with a specific Provider, does not recommend, endorse or make any representations or warranties regarding the Providers or Services. It simply provides a list consisting of the most suitable Providers based on the specific needs of the Patient.
- If the patient schedule an appointment through the Website, he acknowledges and agrees that he is entering into a direct relationship with the Provider and that Mediphi does not provide, and has no responsibility or liability of any kind for the services provided by the Provider or the actions or inaction of such Provider.
- As part of the Service, Mediphi will provide the patients with the following information:
- Information about Patient’s package;
- Information about the costs of the Patient’s package;
- Information about health formalities is required for the journey and the stay.
- Information about the transportation and the accommodation before the Patient’s arrival.
- Mediphi does not operate or control the services offered by the service provider, hotel, travel or transfer companies. By accepting this agreement, the Patient agrees that the use of third party providers is without warranties of any kind by Mediphi. Under no circumstances are Mediphi is liable for any damages arising from the transactions between the patient and third party healthcare, accommodation, travel or transfer providers. Mediphi advises the Patient to obtain and read all of the third-party Provider’s terms and conditions before acquiring Booking from Mediphi.
- Mediphi services are protected by copyright, trademark, and other relevant laws of Turkey. Patients acknowledge and agree that any feedback, comment or suggestion they provide regarding Mediphi and its services is entirely voluntary. Mediphi has the right to use such feedback, comment or suggestion without any obligation to the Patient.
- Mediphi services are available to individuals who are 18 years or older. Legally authorised persons are entitled to use Services on behalf of a third person below the age of 18 on the condition of informing Mediphi of any activity performed on behalf of the afford-mentioned third person.
- Mediphi discloses details and information on Providers based on data, either provided by the Providers or collected and curated from online and offline information from a variety of sources. Although Mediphi uses reasonable skill and care in performing the Services, it will not verify if, and cannot guarantee that, all information provided is accurate, complete or correct, nor can Mediphi be held responsible for any errors (including manifest and typographical errors), inaccurate, misleading or untrue information provided by the Providers or non-delivery of information by the Providers. The Website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level or qualification of any Provider.
- Mediphi reserves the right to access, read, preserve, and disclose any information as it reasonably believes is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Mediphi, its users and the public. Mediphi discloses personally-identifying information to third parties, Providers except in accordance with our Privacy Policy.
- The Services that Mediphi provides are always evolving, and the form and nature of the Services may change from time to time without prior notice to the Patient. In addition, Mediphi may stop (permanently or temporarily) providing the Services (or any features within the Services) to patients and may not be able to provide them with prior notice. Mediphi also retains the right to create limits on use and storage at its sole discretion at any time without prior notice to the patients.
Cancellation and Changes
- If Mediphi has to cancel or change the Patient’s booking, the Patient will be informed. In such circumstances, the Patient can choose to rearrange the procedure with the assistance of Mediphi or cancel the booking and get a refund calculated on a scale. However, Mediphi is not responsible for any losses or expenses the Patient suffer because of circumstances beyond Mediphi’s control. Those circumstances or force majeure include flight delays or cancellations, terrorist activity, war, civil unrest, strike, natural disasters like hurricanes, flooding, earthquake, epidemic or pandemic, etc.
- Parties may request from each other for the continuation of these Terms after the termination of the Force Majeure events. If the force majeure event lasts more than 30 (thirty) days, both parties may terminate the agreement, or any appointment made unilaterally.
- The treatment plans offered by Mediphi are purely based on the information (i.e. the pictures, test results, prescriptions, x-rays, etc.) provided by the Patient and reviewed by the Provider. Therefore, the treatment plan may change when the Service Provider examines the Patient in person before the procedure.
- If such a change occurs, the Patient has the option not to go ahead with the proposed treatment. In such circumstances, he will receive a refund after deductions for, among other things, tests and consultations. Please be advised that Mediphi is not responsible for refunding the Patient’s accommodation, travel and transfer costs as those arrangements are made through third-party providers, which are not in Mediphi’s control nor operated by it.
Patient’s Responsibilities
- Patients are responsible for ensuring to have the following:
- A valid, acceptable passport.
- A visa, if necessary.
- Other required documentation.

If asked for, patients are responsible for submitting, in advance of travel, passenger information to their airline.

Patients must meet the entry requirements for both their final Destinations and any stop-off points en-route.

Patients accept that in the event of their failure to satisfy the required information or the information or documents provided by the Patient being incorrect, patients may be refused carriage and entry to the country they are visiting. Patients accept and acknowledge that in the event of this eventuality, they will be solely responsible for all resultant losses, and Mediphi will accept no responsibility or liability thereof.

Patients are solely responsible for any fines or costs (including the costs of an immediate return flight) they accrue because of their failure to travel with the required passport, visa or other documentation. Mediphi accepts no liability in this situation, and no compensation, expenses, refund or another sum will be paid.

Mediphi does not accept responsibility for the patients who missed their flights, including their connections. Patients are responsible for providing all necessary documents, including passports and visas.

Mediphi advises patients to purchase insurance for any losses suffered because of insolvency, travel problems or medical issues.

By accepting these Terms and Conditions, patients agree to act in compliance with all the laws and regulations in Turkey related to the Services they are provided by Mediphi and the Providers.
Data Protection
- Before the Patient’s journey begins, Mediphi must submit details of the Patient’s medical history to his chosen Provider in Turkey. This is partly to ensure the Patient’s suitability for the planned medical service. By accepting these Terms and Conditions, the Patient agrees to Mediphi’s sharing the details of his medical history, including his pictures, test results, prescriptions, x-rays, with his Provider. Mediphi is not liable if the medical history form has not been completed thoroughly or honestly or if any information is withheld.
- By accepting these Terms and Conditions, the patient permit Mediphi to obtain his file (including his treatment plan, examination and treatment results along with before and after pictures) from the Service Provider for its records. Mediphi assures the patients that it will not sell or otherwise transfer patients’ personal information to any party for any purpose other than to provide the services patients’ request.
- Materials including information related to Patients’ medical history will be held in the strictest of confidence. Mediphi will not disclose any data without patients’ consent, and it will only use it as set out in Privacy Policy.
- To ensure privacy, Mediphi maintains all patient information in compliance with data protection legislation applicable ( Law no.6698) in Turkey regarding the use and disclosure of personal health information.
- The before and after pictures of the patients can be used for demonstrative purposes and might be presented only to show possible results from various procedures. We hereby undertake that images of patients will not be retouched or enhanced in any way to change the appearance of the procedure or treatment, and patients’ ID will not be disclosed in the visuals. Mediphi will not sell or rent any personal information to third parties. By accepting these Terms and Conditions, patients consent to the probable use of their before and after pictures by Mediphi in order to operate and improve its Website, to process Patient’s transactions, to provide customer service, to perform research and analysis aimed at improving its products, services and technologies, and to display content that is customised to patients’ interests and preferences.
- The applicable law is the relevant law in force in Turkey, and any conflict arising from this agreement is subject to the exclusive jurisdiction of the courts of Turkey.
Use of Website
- All of the Website assets, including the system of organisation and presentation of the materials at the Website, are the property of Mediphi. These materials include but are not limited to the design, layout, look appearance and graphics. Website and its materials are protected by legal and subordinate acts relating to intellectual property, including but not limited to copyright laws and other similar laws.
- Unconditioned use and reproduction of the materials presented at the Website without the written permission of Mediphi is prohibited.
- Users may only use the Website (including all the related materials to it) for their personal, non-commercial use. Users must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of Mediphi materials. When using any information from the Mediphi site, an active link referring to the source is mandatory.
- At times, Website failures may happen due to an Internet connection, software operation, data transmission, etc., and it is possible that an incorrect or incomplete copy of the information contained on the Website pages may occur. Similarly, the Website pages may contain malicious code or programs infected with computer viruses.
- Mediphi is not responsible and bears no liabilities connected to the work of any software, the presence of any computer viruses or other elements with malicious code, the presence of destructive or unsafe files that can be distributed or otherwise affect software and hardware upon the User’s review of the Website, the access to any information on the Website, or the downloading of any files from the Website. Mediphi does not purposely distribute any kinds of viruses; however, the Company strongly encourages the use of anti-virus software or other protective programs during interaction with all Websites.
